ADMINISTRATION OF DECEASED ESTATES

Advising on and preparing applications for grants of Probate and Letters of Administration, preparation of Deeds of Family Arrangement to vary provisions in Wills, advice on and conducting challenges to Wills, and deceased estates pursuant to the Inheritance (Family and Dependants Provision) Act.

CAPITAL RAISING – PROSPECTUS

Drafting of prospectuses for the raising of capital for managed investment schemes, including vineyards, olives, forestry, mining and industrial entities, and advising in relation to Australian Stock Exchange listings where appropriate.

COMMERCIAL PROPERTY LEASES

Preparation of commercial property leases for retail shops and shopping centres, high-rise buildings, strata-titled complexes and standalone buildings, advising prospective tenants on retail shop and commercial property leases, drafting Default Notices where tenants are in arrears in rent or in breach of the terms of their lease, and advising on terminating leases where necessary.

EMPLOYMENT LAW

Provision of advice on industrial relations and employment law both to employers and employees relating to employment contracts, entitlements, and individual and collective workplace agreements including advice on compliance with the Fair Work Act.  We also handle employment claims including unfair dismissal and employment entitlements claims in the Federal and State jurisdictions where permissible.

ESTATE PLANNING AND BUSINESS SUCCESSION PLANNING

Preparation of estate planning documents and advising on estate planning issues including taxation issues, treatment of estate and non-estate assets, use of the testamentary discretionary trust structure, and trustee discretionary powers.

Preparation of business succession planning documentation and advising on how to structure business succession agreements to take account of the involuntary departure of a principal from a business (through death, total and permanent disablement or trauma) and/or voluntary departure of a principal from a business (by retirement or sale of an interest in the business), related funding arrangements and taxation implications

FRANCHISES

Preparation of franchising agreements, advising potential franchisees on franchise agreements, and acting on sale and settlement of franchised businesses.

LITIGATION

Conduct of litigation in all Courts and Tribunals in Western Australia, including the Magistrates Court, the State Administrative Tribunal, the District and Supreme Courts and the Federal and High Courts of Australia.

MORTGAGES AND SECURITIES

Preparation of mortgages, loan agreements, acknowledgements of debt and similar financial arrangements for private lenders and arranging registration of documentation over land titles in order to secure repayment to the lender.

PATENTS, COPYRIGHT AND TRADE MARKS

Advice with respect to protecting and licensing the use of intellectual property including patents, copyright and trade marks, preparation and registration of trade mark applications and advice in relation to infringements in all areas of intellectual property.

WILLS AND ENDURING POWERS OF ATTORNEY / GUARDIANSHIP

Drafting of Wills including tax effective Wills incorporating testamentary trusts, advice on related issues such as protective trusts for incapacitated beneficiaries, guardianship clauses, the education and maintenance of minor children, provision for children from prior marriages, dealing with potential Will challenges, the role of the executor, and estate administration.

Preparation of enduring powers of attorney and enduring powers of guardianship, advising on related issues such as the permitted uses of the power and the rights and obligations of the recipient of the power.
